Informative letter March 09’. 08/04/2009

We would like to inform you of some of the innovations, consultations and recommendations with the purpose of avoiding new sanctions to our clients :

1. Certificate of Activity: After having received several sanctions, in and out of Spain, for not being able to demonstrate the driver’s activity when he has not been driving or doing any of the activities foreseen in this certificate, we asked the Ministerio de Fomento) (Ministry of Public Work). We, hereby, attach their response and the possible solution to these suppositions.

2. Notification of fines from the D.G.T via internet or mobile phone. We summarize the procedure to get registered as users of this new form of notification of traffic sanctions.

3. Information that the CMR must contain. We summarize all the data that must appear in the CMR. We also recommend you which information should always be reflected on the CMR in order to avoid possible “mistakes” from the police when interpreting the way done by your vehicle. It’s important to indicate all the changes of truck or trailer done on the same trip writing down all the plate numbers of the vehicles concerned.

Compulsory Certificate of Movement.15/05/2007

A new official form has been published which is valid for justifying periods when the driver has not been driving company vehicles on official duty, this form must be original (not a photocopy) and signed both by the driver and the company manager. It will accompany the relevant discs or digital files which justify the duties undertaken by the driver during the current week and the previous 15 days and must be produced by the driver at any police check. This form is valid and accepted in all European Union countries. Any other type of form, letter or document is no longer acceptable.

Regulation 561/2006.29/03/2007

As we informed you last May 2006 on 11th April  2007 the other part of the  Regulation CE 561/2006 will take effect, this part refers specifically to daily rest periods as well as weekly and any other interruptions to driving. All of these periods which do not comply with this Regulation will be sanctionable from 11th April. Professional diesel usage. 17/01/2007

Last 30th November 2006 a new law was published (Ley 36/2006) in the Official Spanish Gazette) with measures to prevent fiscal fraud, introducing among other issues, the right to a partial refund on fuel taxes.

Register for the transportation of Livestock. 17/01/2007

Special requirements came into force on 20th June 2006 (Decreto 268/2006) with the creation of the Register of Transportation of Livestock, as well as the Register of Cattle operators. This document also establishes the rules of authorization, registration and operation.

As a result of this decree, all transporters and their vehicles are required to be registered in this register, if they are resident in Catalonia and transport live animals, and they need authorization to do so. Moreover, all vehicle owners who are already registered in the Register, should renew their registration.

International Transport entering the United Kingdom and illegal immigration.07/10/2006

“The Immigration and Asylum Act 1999” introduced a series of fines which apply to those who are responsible for the transportation of illegal immigrants to the United Kingdom. According to this law, drivers who do not take the necessary security measures to avoid the entry of stowaways into their vehicles will be penalized.
